15.1 Agreement to Arbitrate
You and Greater Golf House, a Kiler Companies, LLC company, agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Services, or the relationship between you and the Company shall be resolved exclusively through final and binding arbitration, rather than in court, except for claims that may be brought in small claims court or as otherwise provided in this agreement.
15.2 Arbitration Procedures
Arbitration shall be conducted by a single neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) then in effect, except as modified by this agreement.
(1) The arbitration shall take place in the State of Iowa, unless both parties agree in writing otherwise.
(2) The arbitration must be conducted in person or virtually at the arbitrator’s discretion.
(3) The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15.3. Class Action Waiver
You and Greater Golf House agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of a representative or class proceeding.
15.4. Governing Law
This Arbitration Agreement shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles.
15.5. Severability
If any part of this Arbitration Agreement is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
15.6. Exceptions
This agreement does not require arbitration for: (1) Claims brought in small claims court; (2) Injunctive or equitable relief related to intellectual property rights or unauthorized use of the Services.
16. Changes to Terms
We may update these Terms at any time. Updates take effect immediately upon posting. It is your responsibility to review them regularly.
17. Miscellaneous
17.1 Severability
If any part of these Terms is invalid, the remainder remains in effect.
